Kapil Sharma is in news since a week now, thanks to his tweet against a corrupt BMC official in which he tagged Modiji too. This tweet invited lot of irk from Modi fans. However, all this has put Kapil Sharma in big trouble and for this, he might be imprisoned for a period of 3 years.

With this, the issue of his illegally constructed 9th floor flat at Goregaon’s DLH Enclave, was highlighted. Now the police officials have filed an FIR against Kapil, Irrfan Khan (Who also owns a flat there), 3 individual flat owners on the same floor (Shri Verma, Sara Maine and Gurdeep Narang) as well as the builder of DLH.

In June, a complaint was filed at Oshiwara Police Station and a notice was served to Kapil and other flat owners, but there was no response whatsoever. Neither did they replied to the officials nor did they change the plan of construction.

Kapil Sharma is booked under section 53(7) under the MRTP 1966 act, since he failed to comply with those notices issued by civic officials, with regards to unauthorized constructions.

Oshiwara Police Officials had asked BMC to submit all the necessary documents on 12th July itself, so that an FIR can be filed; but they were submitted on 24th of August. Now, finally the FIR has been filed by Abhay Jagtap, a P-South ward sub engineer.

Usually, the punishment under this section includes imprisonment ranging from 1 month to 3 years, along with a fine ranging from Rs 2000-5000.

Although reports say that Kapil has already sold his flat 3 months back, after he got a notice, he is still liable for illegal changes. Sources say “Even if the flat’s been sold, the owner who made the changes is liable. He is supposed to restore it as per the approved plan or face prosecution.”
