Gone are those days, when women used to prefer living in joint families after marriage. Now, all they want is ‘Freedom’ and ‘Space’. Yes, they just hate those restrictions and try their best to convince hubbies to get separated from parents. Earlier, husbands had no option but to give up; but now, things have changed.
The Indian Judiciary has taken care of this issue and a new law is passed, according to which a husband can divorce his wife, if she tries separating him from his parents. This law was actually favorable for all those typical hubbies, who were finding it difficult to speak even a word against it.
However, this is not the end! There is one more law which has been passed in favor of men, God knows what has happened, so many favorable laws for men? Well, as per the latest law, you can divorce your wife if she denies physical relationship for long. Yes, this is indeed true!
Delhi High Court stated that if a woman denies s3x to her husband for long, without any valid reason or justification, it leads to mental cruelty and on this ground, he can file for divorce.
The court passed this verdict, after a case came to light, wherein the wife didn’t allow her husband to have physical relation for 4.5 years, even though she didn’t have any sort of physical disability.
This husband filed plea for divorce in the year 2013, but the court refused it saying that the standard of cruelty proved by him didn’t match the cruelty mentioned in Hindu Marriage Act of 1955.
However, the man challenged this order once again. The court noted that the wife stopped appearing for hearings, even though legal notice was served to her. The husband told the court that they were married since 26th of November 2001 and had 2 sons, one aged 10 and the other aged 9.
He claimed that his wife mentally tortured all the family members and didn’t show interest in any household chores. Parents couldn’t tolerate this conduct and hence, asked him to stay separately with wife, by creating a partition in same house. Then, the husband said that she didn’t allow him to have S3x with her, for almost 4.5 years.
Since these allegations weren’t denied by the wife, the court considered his appeal this time and granted divorce.
Bench of Jusices Pratibha Rani and Pradeep Nandrajog stated;
“In view of the foregoing discussion, we are of the considered view that the husband has fully established that he was subjected to mental cruelty by the wife by denying sex to him for a long period despite living under the same roof, without any justification and though she was not suffering from any physical disability,”
