If you are living with your boyfriend and girlfriend, stop treating them like so, because they have now attained the status of husband and wife. As per the latest rule declared by the bench of Justice MY Eqbal and Justice Amitava Roy, people living in together would raise the presumption of a valid marriage.
“It is well settled that the law presumes in favor of marriage and against concubinage, when a man and woman have cohabited continuously for a long time. However, the presumption can be rebutted by leading unimpeachable evidence. A heavy burden lies on a party who seeks to deprive the relationship of legal origin,” the bench said.
The judgement and new amendment were continuously asked for and since 2010 many rules have been favored for the couple living together without actually committing legal marriage. In fact previously, Supreme Court also gave the child born from Live-in couple the status of being legitimate.
With all rules being favored towards the Live-in relationship, it clearly looks like as it is the future of India with less legal hassles.
