The dark times, just seem to get darker, even after trying and crying so hard for the matriarchal society to respect and restrain themselves from forcing themselves on the female population, its all in vain!
Now we all had hoped on the legal system of every country, but it seems that hope is eradicated with this very absurd and unjust verdict given by the Mexican court over the case of sexual assault on a 17- yr old girl.
The bizarre verdict, in this case, was that a 21-year-old man accused of abducting as well as raping a schoolgirl was freed from the clutches of the law by Mexican judge on grounds that said, he didn’t enjoy himself.
Well, as according to the reports by Washington post, the incident happened on New Year’s Eve of 2015, the accused, Diego Cruz, along with his four friends had abducted the 17-year-old victim and then sexually assaulted her.
The judge in his verdict mentioned that
“although Cruz had touched the victim’s breasts and penetrated her with his fingers, he had done so without “carnal intent” – and so was not guilty of assault”
Adding to the verdict he said that
” Cruz touched the minor and, at the same time, did not intend to reach a vaginal, anal, or oral intercourse”.
In his verdict, the judge noted,
“Touching or incidental rubbing, be it in a public or private place, would not be considered a sexual act, if the element of intent to satisfy a sexual desire at the expense of the passive subject is absent”.
On the account of this unjust and undoubtedly shocking verdict, the father of the victim, Javier Fernández, said that “with this legal protection anybody would be able to touch a young girl without penal consequences,” as relayed by the local media.
Coinciding to this tragic episode, the victim speaks about her emotional state and takes her stand on the issue, on a Facebook post she writes,
“I’m not hiding. I’m not saying anything but the truth. I have nothing to repent” adding to it, “I’ve gone drinking. I’ve gone to parties. I’ve worn short skirts like many girls my age… and for that, I’m going to be judged? For that, I deserved what happened?”
Meanwhile, Cruz who actually belongs to a wealthy family was extradited to Mexico and now has fled to Spain after the incident.
