In the last frantic call to her boyfriend, Rahul, Pratyusha Banerjee accused him of cheating her and separating her from parents. This was revealed yesterday by a prosecutor to Bombay High Court. Anticipatory bail was granted by the high court to Rahul, who is held responsible for the suicide of Pratyusha.
His custody was demanded by the prosecution as they wanted to carry out further investigations. However, this request was turned down by the court after they observed that murder charges aren’t yet applied on Rahul.
Murder case should be registered against Rahul?
Nilesh Pawaskar, the Special Public Prosecutor stated that presently these investigations are revolving around IPC 306 and IPC 302. They expect Rahul of having done much more than just abetment, but everything can be known only after custodial interrogation.
Justice Mrudula Bhatkar stated that if evidence is present, then a murder case can be registered against Rahul. Custodial interrogation isn’t needed for registering murder case. She further says that when the accused is absconding, a murder case can be registered.
Pawaskar also stated that Rahul continued to impress girls and told them that his mother is an MLA and that he is an owner of a Sri Lankan Casino. He also stated that Rahul faked of having 150 acres of land at his native place.
Last conversation of Rahul and Pratyusha!
A DVD was presented by the prosecutor which had the last conversation between Rahul and Pratyusha who lived together. This conversation took place around 3.43PM on the 1st of April. However, Aabad Ponda, the lawyer of Rahul argued that as per several court judgments it is stated that speaking last on the phone call doesn’t mean abetment. Pratyusha and Rahul were quite happy in their relation. For proving abetment, there must be provocation and instigation. The judge noted that prosecution had failed in showing that Rahul committed any intentional act for provoking Pratyusha to suicide. The court has ordered Rahul to visit Bangur Nagar Police station thrice a week.
