Court Acquitted Man Who Ran Over Child, As The Accident Spot Had No Zebra Crossing!

Road accidents contribute significantly in the number of deaths that take place in India but they are not always about rash driving or due to the mistakes of drivers; sometimes they happen because of pedestrians too.

In Mumbai, a 26-yr youth who ran over a boy was acquitted by the court because the boy was trying to cross the busy road and there was no zebra crossing or signal. The accident took place at the road outside NSCI at Haji Ali. The court stated,

“Admittedly, the boy was crossing the road not from the zebra crossing. Admittedly, there was also no signal pole at the place of accident. Under such circumstances, it cannot be said that there was fault or negligence of the accused.”

The accident took place on the evening of 23rd Oct, 2012, and the hearing took place in the court in March 2013. The main eyewitness in the case was the boy’s brother who told the court that they both along with their sister went to buy groceries and as they were trying to cross the road, his brother was hit by the vehicle. The boy fell unconscious and was taken to the Nair hospital; however, he died the next day. The witness also told that the driver stopped the vehicle at a little distance from the accident spot so he saw the hitting vehicle.

During the hearing, the court observed that the witness agreed to the fact that they were trying to cross the road when there was heavy traffic and his brother showed negligence in terms of safety. Other than the main witness, there were two other witnesses also and all of them said that there was no zebra crossing or signal at the accident spot.

After considering these points, the court came to the conclusion that nothing could prove that the accident had taken place due to rash or negligent driving. The court stated,

“For that purpose, specific cogent evidence is must but, the prosecution has failed to bring cogent evidence. In such circumstances, accused deserves acquittal.”
