Sometimes, it becomes difficult to decide what’s right and what’s wrong or who’s speaking the truth or telling a lie. The same has happened in this case wherein a man is charged with unnatural sex and cruelty by estranged wife. The man regarded it as a “false and vexatious complaint” and knocked the door of Mumbai HC in order to seek pre-arrest bail.

He was denied any relief from a sessions judge taking into consideration the fact that charges against the man were serious in nature. He was granted no interim relief by Bombay High Court previous week and the hearing of the case is scheduled on Monday. Just to inform, the couple is highly educated and works in a private company.

It was in the month of February that he was charged under Section 377 and Section 498-A of Indian Penal Code. As per the woman, he was involved in the heinous act of unnatural sex with her as opposed to her desires. Not only this, he also recorded their relationship as well as showed the woman pics of his extramarital affair. The woman said that he had an extramarital affair with a colleague; however, he refused this “bald allegation”.

According to his claims, they are married for two years and his wife doesn’t live with him for more than a year. Lawyer Filji Frederick has filed his petition “under extremely distressing and compelling circumstances”. As per the petition, “There are no medical reports to substantiate the offences under IPC sections 377 and 323. There is no complaint filed by her earlier.”

Their counsels, Niranjan Mudergi and S V Marwadi, had been prepared for an argument on 20th March; however, the state counsel Arfan Sait asked for time. The hearing was scheduled on 27th March by Justice Sadhana Jadhav.

As per his petition, the woman tied knot with the man “only for his money” and with time, a rift came up in their relationship. He went on holidays with her and tried a lot for saving his married life till December 2015.

They submitted a plea of divorce with mutual consent last April and she asked for alimony worth Rs 45 lakh. He was granted pre-arrest bail a month later after which she lodged a case under Protection of Women from Domestic Violence Act. On the grounds of cruelty, she sought divorce and the man also filed for the same, citing the same reason. She asked for Rs 1 crore for permanent settlement in Jan; however, when the man wasn’t able to pay the amount, she lodged a criminal case against him as well as his parents.
