Quite often, we come across a girl who is tortured and misbehaved by her in-laws but it’s very rare when we have seen any such case where a woman has misused law and filed a false domestic violence case against her in-laws and husband.

The news comes from New Delhi where court has rejected the complaint of a lady who said to have been suffered domestic violence by her in-laws and husband. According to the court, the woman is noticed to have misused laws, utilizing them for extorting money from her husband for her own personal benefit and taking this into consideration, she is fined Rs. 1 lakh.

Her case has been dismissed by Shivani Chauhan, the metropolitan magistrate, who is of the opinion that the lady has misrepresented many allegations as well as concealed significant details for harassing in-laws.

As per the court, usually females have been seen as victims of domestic violence and it’s just for providing them relief, the creation of PWDV (Protection of Woman from Domestic Violence) act is done.

Nevertheless, the court has observed, “the testimony of the complainant (woman) throws light on the conduct of the complainant and the extent, to which she has falsified and concocted various allegations and has suppressed important facts in order to harass the respondents (husband and parents-in-laws) and had misused the PWDV Act as a tool to extort unjustified money from respondent No. 1 (husband) for unjustified personal gain.”

“It is a fit case which calls for imposition of exemplary cost on complainant, so that like minded people are dissuaded from resorting to such mala fide practices,” as stated by the court at the same time as rejecting her case and ordering her to deposit Rs. 1 lakh in Blind Relief Association account.

Further, the court added, “The imposition of cost is in furtherance of the principle that wrongdoers should not get benefit out of frivolous litigations.”

The complaint made by the lady said that she had a love marriage and it took place at Patna in November in the year 1989. But some time later, there started to grow many differences between her and her husband who began to harass her in verbal as well as physical manner. Not only this, her in-laws did not interfere in the matter and seemed as if they had got nothing to do with what was happening.
